CookBookGPT Terms of Service

Effective as of June 19, 2025

1. Introduction & Acceptance of Terms

1.1 These Terms of Service (“Terms”) govern your access to and use of CookBookGPT, an AI-powered recipe generation platform provided by CookBookGPT (“we,” “us,” or “our”).

1.2 By creating an account, accessing, or using CookBookGPT, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1.3 These Terms are effective as of June 19, 2025 and supersede all prior versions.

1.4 We may update these Terms from time to time by posting the revised version at this page. Changes take effect immediately upon posting.

2. Definitions

“Account” means your user account registered with CookBookGPT.

“AI-Generated Content” means recipes, text, or other materials created by CookBookGPT’s AI in response to your prompts.

“Community Cookbook” means the shared collection of recipes contributed by users and made publicly viewable through the Service.

“Content” means all text, images, data, and other materials that are generated, uploaded, or submitted by you or through the Service (including recipes, prompts, grocery lists, and AI-Generated Content).

“Grocery List” means the list of ingredients you assemble and save within the Service for shopping purposes.

“Meal Planning” means the Service feature that helps you schedule or organize multiple recipes across days or weeks.

“Paid Features” means features of the Service that require a Subscription (e.g., grocery list access and Meal Planning tools).

“Service” means the CookBookGPT website, application, and any related services provided under these Terms.

“Subscription” means any paid plan that grants access to Paid Features of the Service.

“User Content” means Content created or submitted by you through the Service (e.g., recipe prompts, saved recipes, Grocery Lists).

“We,” “Us,” or “Our” means CookBookGPT.

“You” or “Your” means the user who has registered for or is using the Service.

3. User Accounts & Registration

3.1 Account Creation. To access certain features of CookBookGPT (including saving recipes, building Grocery Lists, and using Meal Planning), you must create an Account. You may register by providing a valid email address and selecting a username, or by using Google Sign-In. You agree to provide accurate and complete information during registration and to keep your Account information up to date.

3.2 Eligibility. CookBookGPT is available to users of all ages, including children under 13. You may register and use the Service independently, provided any information you submit is accurate and you have the right to provide it.

3.3 Account Security & Sharing. You are responsible for safeguarding your password and any authentication credentials. Accounts may be shared among members of a single household but must not be shared outside of your household. You agree to notify us immediately at support@cookbookgpt.com if you suspect any unauthorized use of your Account.

3.4 Account Termination. We may suspend or terminate your Account at any time, without notice, if you breach these Terms or engage in prohibited conduct.

4. Acceptable Use & Prohibited Conduct

4.1 Acceptable Use. You agree to use CookBookGPT only for lawful and personal purposes, including:

  • Generating recipes and meal plans for your own or household use.
  • Saving and organizing your own recipes, Grocery Lists, and Meal Planning schedule.
  • Contributing to the Community Cookbook in accordance with these Terms.

4.2 Prohibited Conduct. You must not, directly or indirectly, do any of the following when using the Service:

  • Illegal Activities: Use CookBookGPT to facilitate any unlawful activity or to plan or commit wrongdoing.
  • Infringing Content: Upload, share, or generate User Content that infringes on any third-party intellectual property rights.
  • Reverse Engineering: Attempt to reverse engineer, decompile, or otherwise attempt to extract source code or underlying algorithms from the Service or API.
  • Unauthorized Access: Attempt to gain unauthorized access to other users’ Accounts or data.
  • Disallowed Content: Create or distribute content that is defamatory, obscene, abusive, harassing, hateful, or otherwise objectionable.
  • Spam & Scraping: Use bots, scrapers, or other automated methods to collect data from CookBookGPT or to send unsolicited messages.
  • Account Sharing Beyond Household: Share your Account credentials outside of your household.
  • Service Disruption: Interfere with or disrupt the integrity or performance of CookBookGPT or its infrastructure.

5. Payment & Subscription Terms

5.1 Subscription Plans. CookBookGPT offers free and paid Subscription plans. Free users have access to basic recipe generation and community features. Paid Subscriptions unlock Paid Features such as grocery list access and Meal Planning tools.

5.2 Billing & Payment. All paid Subscriptions are billed in advance on a monthly basis via Stripe. By subscribing, you authorize us to charge your chosen payment method through Stripe’s tokenized system. You agree to provide accurate billing information. Stripe securely processes and stores payment tokens; CookBookGPT does not store raw credit card data.

5.3 Free Trials & Promotions. We do not offer free trials at this time, but may do so in the future. Unless otherwise stated, promotional pricing will convert to standard paid Subscriptions at the then-current price when the promotion ends.

5.4 Cancellation & Refunds. You may cancel your Subscription at any time via your account settings. Cancellation takes effect at the end of your current billing cycle. We do not provide refunds for partial billing periods, except as required by law or at our sole discretion.

5.5 Downgrades & Price Changes. Downgrading from a paid plan to a free plan takes effect at the start of your next billing cycle. We may adjust Subscription fees. We will notify you of any fee changes at least 30 days before they take effect. Your continued use after the change constitutes acceptance of the new fees.

6. User Content & Intellectual Property

6.1 Your Content. You retain all ownership rights in any User Content (e.g., your recipe prompts, saved recipes, Grocery Lists) that you submit or generate through CookBookGPT.

6.2 License to Us. By submitting or generating User Content, you grant CookBookGPT a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and providing the Service, including the Community Cookbook feature. This license continues even if you delete your Account, but only for content you have contributed to the Community Cookbook.

6.3 AI-Generated Content. All AI-Generated Content (e.g., recipes and meal plans created by our AI) is owned by CookBookGPT. You may use, copy, modify, and distribute AI-Generated Content for personal, non-commercial purposes.

6.4 Feedback. If you provide feedback or suggestions about CookBookGPT (“Feedback”), you grant us a perpetual, irrevocable, royalty-free license to use and incorporate that Feedback into the Service or our products without restriction.

6.5 Trademarks & Copyright. “CookBookGPT” and our logos are trademarks of CookBookGPT. You may not use our trademarks without our prior written permission. All other trademarks appearing on the Service are the property of their respective owners.

6.6 DMCA & Infringement. If you believe any content on the Service infringes your copyright, please contact us at support@cookbookgpt.com with a notice containing the information required under the DMCA.

6.7 Community Cookbook Persistence. Once you contribute User Content to the Community Cookbook, that content will remain publicly available through the Service and cannot be removed at your individual request. You still retain all ownership and copyright in your content and are free to copy, modify, publish, or remove it outside of CookBookGPT.

7. Disclaimers & Limitation of Liability

7.1 No Warranty. COOKBOOKGPT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COOKBOOKGPT, ITS AFFILIATES, OR ITS SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID, IF ANY, TO COOKBOOKGPT IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

8. Indemnification

You agree to defend, indemnify, and hold harmless CookBookGPT, its affiliates, officers, directors, employees, and agents (collectively, “Indemnitees”) from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with:

  • Your use of the Service, including any User Content you submit or actions you take.
  • Your violation of these Terms.
  • Your violation of applicable laws or third-party rights.
  • Any Prohibited Conduct under Section 4 committed by you.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

9. Governing Law & Dispute Resolution

9.1 Governing Law. These Terms and any dispute arising out of or related to them or your use of CookBookGPT will be governed by the laws of the State of California, without regard to its conflict of law principles.

9.2 Informal Resolution. Before initiating any formal dispute resolution, you and CookBookGPT agree to try in good faith to resolve any dispute informally by contacting the other party at support@cookbookgpt.com. If we cannot resolve the dispute within 30 days, you may pursue the matter as set forth below.

9.3 Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof will be finally resolved by binding arbitration under the Optional Code of Procedure of the American Arbitration Association.

Location: The arbitration will take place in San Mateo County, California, unless you and we agree otherwise.

Fees: The AAA rules will govern payment of filing fees and your responsibility for the arbitrator’s and administrative fees.

Judgment: The arbitrator’s award may be entered as a judgment in any court of competent jurisdiction.

9.4 Small Claims & Injunctive Relief. Nothing in this Section prevents you from bringing issues to small claims court if your claim qualifies, or from seeking injunctive or other equitable relief in a court of competent jurisdiction, before, during, or after any arbitration.

10. General Provisions

10.1 Entire Agreement. These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and CookBookGPT concerning its subject matter and supersede all prior or contemporaneous agreements, proposals, or representations, written or oral.

10.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.

10.3 Waiver. No waiver of any term or condition of these Terms will be deemed a further or continuing waiver of such term or condition or any other term or condition.

10.4 Assignment. You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations at any time without restriction.

10.5 Notices. We may provide notices to you via email (to the address you provided) or by posting on the Service. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.
